DOLE issues pay rules for long weekend

WITH the long weekend ahead, the Department of Labor and Employment (DOLE) yesterday reminded employers of the existing pay rules that will be implemented for the special non-working day today, Friday, and the regular holiday on Monday.

Based on Labor Advisory No. 9-2024, the DOLE said the “no work, no pay” principle shall apply for the special non-working day today in observance of Ninoy Aquino Day.

“If the employee does not work, the ‘no work, no pay’ principle shall apply unless there is a favorable company policy, practice, or collective bargaining agreement (CBA) granting payment on a special day,” said the DOLE.

For work done during the special non-working day, the employer shall pay the employee an additional 30 percent of the basic wage on the first eight hours of work and an additional 30 percent of the hourly rate on the said day for overtime work.

For work done during the special non-working day that also falls on the employee’s rest day, the employer shall pay the employee an additional 50 percent of the basic wage on the first eight hours of work and an additional 30 percent of the hourly rate on the said day for overtime work.

As for the celebration of National Heroes Day on Monday, August 26, the DOLE said those who won’t go to work shall still be entitled to their basic pay.

“If the employee does not work, the employer shall pay 100 percent of the employee’s wage for that day,” said the DOLE.

For work done during the regular holiday, the employer shall pay a total of 200 percent of the employee’s wage for that day for the first eight hours; and an additional 30 percent of the hourly rate on said day for overtime work.

For work done during a regular holiday that also falls on the employee’s rest day, the employer shall pay the employee an additional 30 percent of the basic wage of 200 percent; and an additional 30 percent of the hourly rate on said day for overtime work.
